Scope:
These General Conditions of Sale apply to all orders placed through the website www.laodiseadelvino.com, as well as for all orders received by fax, mail or telephone and whatever in addition, the clauses that may appear on the client’s documents.
Orders:
www.laodiseadelvino.com agrees to accept orders made via the Internet in the terms of these General Conditions of Sale and within the limits of available stocks. In case of out of stock, we will notify you of the lead times necessary to obtain the desired product or we will offer you a replacement product. www.laodiseadelvino.com will honor each order by making one or more deliveries of the products ordered. By validating the order, the customer declares to have read and accept the entirety of the present General Conditions of Sale. Any order will be taken into consideration after receipt of payment and will be confirmed by www.laodiseadelvino.com by email. www.laodiseadelvino.com reserves the right to cancel all orders, non-compliant or doubtful, as well as those from a customer with whom there is any dispute. www.laodiseadelvino.com reserves the right to refuse any order for legitimate reasons and more particularly in the case where the quantities ordered are abnormally high compared to the quantities usually ordered by the customers as consumers.
Prices:
Except for the special cases explicitly specified, the prices indicated are expressed in Euros and are inclusive of all taxes (VAT, excise and all other applicable taxes). The prices displayed are net and excluding participation in shipping and delivery. These shipping costs vary depending on the number of products ordered and the place of delivery.
Validity of offers:
Products are offered within the limits of available stocks. www.laodiseadelvino.com cannot be held responsible for any out of stock that would cause a delay in the delivery of the order. In case of unavailability of one or more products after the validation of the order, www.laodiseadelvino.com undertakes to inform the customer by e-mail as soon as possible. In agreement with the customer, www.laodiseadelvino.com will be able to modify the order, or proceed to the refund of the unavailable product (s) by the credit of the card of payment used during the order.
Delivery:
Except in special cases explicitly specified, www.laodiseadelvino.com delivers in Spain. The shipping costs are automatically calculated on our site following the destination of your wines. Deliveries for any other destination must be subject to a specific quote. Our wines are bought from the vineyards and from some traders when the practice requires (especially Bordeaux) and are stored in our warehouse in Jerez de la Frontera. Except in special cases explicitly specified, the delivery time of orders is 7 working days after receipt of payment. In non-working days are included Saturdays, Sundays and public holidays, as well as days when road transport is prohibited. These deadlines are indicated in the confirmation of the order received by e-mail by the customer. The order is delivered to the delivery address chosen by the customer.
• When receiving your order, it is imperative to open the cartons and carefully check the accuracy of the delivery in relation to the order, to immediately issue any reservations to the carrier. It is the recipient’s responsibility to check that the package has not been opened, or if it shows obvious signs of deterioration (possible breakage). In this case the parcel can be refused by the recipient.
• In the event of absence, the deliveryman leaves a notice of passage presenting the modalities to reprogram the delivery of the order. If the parcel could not be received, it is put on the carriers site. It is up to the recipient to pick up the parcel from the carrier concerned or to reprogram the delivery. The duration of pending is 30 consecutive days. This period does not include the day of presentation at home. Beyond this period, the parcel will be automatically returned to our warehouses. For any forwarding, shipping costs may be charged. It is recommended that the recipient let the wine rest for a few days after transport.
Payment:
Payment for products purchased from www.laodiseadelvino.com is due in full at the time of order. Payments are made by credit card (online payment secured by Sabadell, check, payable to “La Odisea del Vino” or by transfer.
Personal data:
The purchase of wines on the site www.laodiseadelvino.com, requires the customer to communicate a certain amount of personal data concerning him. The information required to be transmitted is indicated by an asterisk. These data, which are necessary for the processing of the order and the management of the commercial relations of www.laodiseadelvino.com with its customers, are secure, kept confidential and are not the subject of any commercial use by third parties. The processing of personal data is governed by Law No. 78-17 of 6 January 1978 relating to data, files and freedoms and from 25 May 2018 by Regulation (EU) 2016/679 of the Parliament European Council and of 27 April 2016 (RGPD).
Responsibilities:
The texts and photos presented on www.laodiseadelvino.com are given only as an indication and cannot constitute a contractual commitment guaranteeing a perfect similarity between the presented product and the ordered product.
Protection of minors:
In accordance with Article L. 3342-1 of the Public Health Code, the sale of alcohol to minors under the age of eighteen (18) is prohibited. The member agrees to be 18 years old by placing his order on the site www.laodiseadelvino.com.
Intellectual property:
The sales contract concluded between the client and www.laodiseadelvino.com does not involve any transfer of intellectual or industrial property rights. The reproduction or representation of all or part of one of the distinctive signs on the site is strictly prohibited and must be subject to prior written authorization. The elements reproduced on the site www.laodiseadelvino.com and the mobile applications, exclusive property of the publisher, are protected by the copyright, the right of the marks and the patent right. Any reproduction and dissemination of these elements, without prior written permission of the publisher, expose offenders to prosecution.
Contractual provisions:
The nullity of a contractual clause does not entail the nullity of all the General Conditions of Sale. These General Terms and Conditions of Sale may be modified at any time: the applicable General Terms and Conditions of Sale are those in effect on the site at the date of the order placed by the customer.
Liability – Force Majeure:
The responsibility of www.laodiseadelvino.com cannot be engaged in the event of non-execution or bad execution of the contract due, either by the customer, or the unforeseeable and insurmountable external fact of a third party, or to a case of force majeure (as defined by the case law).
